The Legislation and Opinion Bureau published 3 TVSDC draft by-laws: by-law for Equivalency of vocational, technical qualifications and certificates, by-law for the Accreditation of TVET Providers, by-law for defining criteria for selecting, classifying trainers, technical and vocational supervisors, and organizing their occupational ranks/ levels.

Under the Equivalency of vocational, technical qualifications and certificates by-law, an equivalency and accreditation committee will be formed to review requests for equivalency and to verify the legality of any TVET provider providing TVET programmes in non-original countries in the manner it deems appropriate.

According to the Accreditation by-law, no facility may practice training tasks and activities before obtaining the necessary accreditation from the Commission.

The Commission will coordinate with the National Centre for Curriculum Development to prepare vocational secondary education programmes, curricula and develop them according to sector requirements. 

 Under the by-law of defining criteria for selecting, classifying trainers, technical and vocational supervisors, and organizing their occupational ranks/ levels, the Commission will classify the TVET trainers to: trainer of trainers, technical trainer, vocational trainer, theoretical trainer, practical trainer, craftsman trainer, production trainer, E-trainer / training facilitator, in addition to any classification that the Council decides to add.

The following is Bylaw No. 20 / 2020, 

Equivalency of vocational, technical qualifications and certificates Bylaw.

Issued pursuant to Item 16, paragraph B, Article 3 of TVSD Law No. 9 of the year 2019

Article 1 – This bylaw shall be titled (Bylaw of Equivalency of vocational, technical qualifications and certificates for the year 2020) and shall enter into force from the date of its publication in the official gazette.

Article 2: The following terms and phrases – wherever mentioned in this Bylaw -shall have the meanings assigned thereto unless the context requires otherwise:

Council: Technical and Vocational Skills Development Council.

Commission: Technical and Vocational Skills Development Commission.

Chief Executive Officer (CEO): CEO of the TVSD Commission 

Equivalence: A document issued by the Commission proves that a non-Jordanian vocational or technical qualification is equivalent to a Jordanian vocational and technical qualification.

Committee: The Committee for equivalence of vocational, technical qualifications, certificates and accreditation, formed according to the provisions of this Bylaw.

Article 3 -) A (:  A committee shall be formed in the Commission called (the Committee for equivalence of vocational, technical qualifications, certificates and accreditation) headed by the CEO, and the membership of: 

  1. Two directors from the directorates of the Commission are chosen by the CEO and one of them shall be delegated as deputy chairman of the committee.
  2. One representative from the Accreditation and Quality Assurance Commission for Higher Education Institutions (AQACHEI) to be delegated by its president.
  3. One representative from the Vocational Training Corporation (VTC) delegated by its Director General.

(B)– The CEO shall designate from the employees of the Commission the Secretary of the Committee, who shall take notes, records its sessions, maintain its records and minutes, follow up the implementation of its decisions and any other tasks assigned by the Chairman of the Committee.

Article 4: The committee meets at the invitation of its chairman or his deputy (if the chairman is absent) at least once a month or whenever the need arises and its meeting is legal in the presence of the majority of its members provided that the chairman or his deputy is present, and its decisions are taken by a majority of the votes of its members.

Article 5-(A): The committee shall assume the following tasks and mandates:

  1. Study requests for equivalence of vocational, technical qualifications, certificates and issue the appropriate decision thereon.
  2. Verify the information in the vocational, technical qualifications and certificates required for equivalency. 
  3. Verify the legality of TVET providers in non-original countries in the manner it deems appropriate.
  4. Any other related tasks referred to it by the CEO

(B)– The committee may invite those it deems appropriate with expertise and competence to seek advice on the equivalency of vocational, technical qualifications and certificates. 

Article 6: For the purposes of equivalency of vocational, technical qualifications and certificates issued by international accrediting bodies, the following shall be considered: 

  1. Submit proof that the applicant for equivalency of vocational, technical qualifications and certificates completed the duration of the training programme in the country that issued the certificate or vocational qualification.
  2. Submit proof that the vocational, technical qualifications and certificates required for equivalency equals the qualifications, certificates and vocational practice licence accredited by the Commission in terms of the level and training accredit hours.
  3. Vocational, technical qualifications and certificates are equivalent to those in the Commission.
  4. Ensuring that the required vocational, technical qualifications and certificates for equivalence qualify their holder to work in the labour market for the country in which the certificate or vocational qualification was issued. 
  5. If the qualification or certificate does not meet the minimum requirements for the equivalency, it will be equivalent to the qualification or vocational certificate that precedes it and fulfils its requirements.

Article 7 – (A (: A request for equivalence of vocational, technical qualifications and certificates shall be submitted in writing to the Commission in accordance with the approved form for this purpose, attached with a copy of the original qualification or vocational, technical certificate approved by the following authorities:

  1. Issuer.
  2. The Ministry of Foreign Affairs of the country where the certificate or vocational and technical qualification is issued.
  3. Jordanian embassy or consulate in the country in which the certificate or vocational and technical qualification is issued.

(B)- The committee shall issue its decision in writing regarding the application for equivalence of vocational, technical qualifications and certificates within a period not exceeding 30 days from the date of submitting the application.

Article 8-(A): The Head of the Council forms a committee to consider objections to the committee’s decisions, which is made up of three members delegated from inside or outside the Commission and which determines in its formation how to meet and take its decisions.

(B) The applicant has the right to object to the Objections’ Committee referred in paragraph A of this article, on the committee’s decision to reject the equivalency of the qualification, vocational, or technical certificate within fifteen days from the date of notification of the committee’s decision. 

(C): The objection committee must respond to the objection within a period not exceeding 15 days from the date of submitting the objection.

Article 9: The Commission is not mandated to equate the following certificates and qualifications:

  1. Academic certificates associated with a degree according to the instructions issued by the Ministry of Education and the Ministry of Higher Education and Scientific Research.
  2. Honorary Certificates.
  3. Certificates not related to a vocational or technical test.

Article 10: The Commission shall collect on submitting an application for equivalence of vocational, technical qualifications or certificates the following fees:

  1. 50 JOD for the issuance of the equivalency document in Arabic
  2. 50 JOD for the issuance of the equivalency document in English
  3. 20 JOD for the issuance of replacement of a Lost or damaged equivalency document.
  4. 10 JOD for the issuance of an additional original copy of the equivalency document or issuing any document related to the certificate equivalency

Article 11: The Council shall issue the necessary instructions to implement the provisions of this bylaw.

Bylaw No. 19 of the year 2020

Accreditation of TVET Providers Bylaw

Issued pursuant to Item 1, paragraph B, Article 3 of TVSD Law No. 9 of the year 2019

 Article 1 – This bylaw shall be titled (Bylaw of the Accreditation of TVET Providers for the year 2020) and shall enter into force from the date of its publication in the official gazette.

Article 2- (A): The following terms and phrases – wherever mentioned in this Bylaw -shall have the meanings assigned thereto unless the context requires otherwise:

Law: Technical and Vocational Skills Development Law.

Commission: Technical and Vocational Skills Development Commission.

Council: Technical and Vocational Skills Development Council.

Accreditation: The decision issued by the Commission in accordance with this bylaw for the establishment proven that it is qualified to provide training, vocational or technical education services. the accreditation has two types: general accreditation and private accreditation.

Establishment: The provider of training or vocational or technical education programmes, including vocational secondary education schools in the public and private sectors in the Kingdom.

Certificate: The vocational or technical certificate related to a level on the national qualifications’ framework, according to the provisions of this bylaws.

(B): The definitions mentioned in the law shall be adopted wherever mentioned in this bylaw unless the context requires otherwise.

Article 3- (A): The provisions of this bylaw shall be applied to the accredited establishment to implement the following programmes:

  1. Technical and vocational training.
  2. Apprenticeships.
  3. Secondary vocational education.
  4. Continuous training.
  5. Any other programmes created by the law.

(B): No establishment may practice tasks and training activities before obtaining the necessary accreditation from the Commission on the basis of the provision of this bylaw. 

(C): Identify the types of accreditation and its conditions according to instructions issued by the Council for this purpose in accordance with the following criteria.

  1. The training programmes shall be consistent and in the line with the needs, requirements of the labour market, and as decided by the Commission.
  2. The establishment must be institutionally listed on the National Qualifications Framework according to the National Qualifications Framework bylaw.
  3. The qualifications of the training and educational programmes must be placed and registered on the National Qualifications Framework in accordance with the National Qualifications Framework bylaw and the Law.

Article 4: The establishment is committed to training trainers, supervising teachers, technical specialists, and students with any of the following types of training and education:

  1. Institutional training and education
  2. Participatory training
  3. Apprenticeship 
  4. On-the job training
  5. E-training and education
  6. Any types accredited by the Commission

Article 5-(A): The accredited establishment under this bylaw is committed to involve its trainers, teachers, supervisors and lecturers at their different occupational ranks/ levels in continuous training programmes to keep pace with developments in the labour market.

(B): When renewing the accreditation, the establishment must provide evidence that its trainers, teachers and lecturers at their different occupational ranks/ levels have received continuous training in order to upgrade their competence.

(C): Evaluating the establishment and its programmes during the accreditation period or when it is renewed by the Commission, according to instructions issued by the Council for this purpose.

Article (6): Regarding secondary vocational education programmes, the Commission shall undertake the following:

(A): Prepare admission basis, standards and requirements for implementing vocational secondary education programmes, and introducing new specializations according to the requirements of sectoral skills Councils.

(B): Participate in the design of vocational tests and exams, and following up their implementation in order to pave its preparation by the Ministry of Education.

(C): Evaluate training and educational programmes, and following up their performance in accordance with instructions issued by the Council for this purpose.

(D): Prepare the basis and standards for equivalence of vocational secondary education certificates and documents issued by international accreditation bodies in accordance with the law.

(E): Coordination with the National Centre for Curriculum Development to prepare vocational secondary education programmes, curricula and develop them according to sector requirements.

Article 7: The establishment that obtained accreditation from the Commission shall be committed to list and register the qualifications on the National Qualifications Framework within a maximum period of three months from the date of obtaining the accreditation.

Article 8: The provisions of this Bylaw shall not apply to whoever enrolled in any of the programmes stipulated in Paragraph A of Article 3 of this Bylaw before its provisions come into force.

Article 9: The Council shall issue the necessary instructions to implement the provisions of this bylaw.

Bylaw No. 15 of the year 2020

Bylaw for defining criteria for selecting, classifying trainers, technical and vocational supervisors, and organizing their occupational ranks/levels 

 Article 1 – This bylaw shall be titled: (Bylaw for defining criteria for selecting, classifying trainers, technical and vocational supervisors, and organize their occupational ranks/ levels for the year 2020) and shall enter into force from the date of its publication in the official gazette.

Article 2: The following terms and phrases – wherever mentioned in this Bylaw -shall have the meanings assigned thereto unless the context requires otherwise:

Commission: Technical and Vocational Skills Development Commission.

Council: Technical and Vocational Skills Development Council.

Trainer: The classified and designated person according to the provisions of this bylaw for training in the TVET sector and persons of equivalent.

Supervisor: The classified and designated person according to the provisions of this bylaw assigned to supervisory duties in the TVET sector and persons of equivalent.

Practicing license: It is an official document issued by the Commission for those who have passed the vocational tests, qualifies them to practice the profession of the trainer or supervisor and confirms that the requirements and conditions of the Commission have fulfilled. 

Article 3: The provisions of this bylaw apply to trainers and supervisors working in vocational or technical training in the Kingdom.

Article 4: The conditions and requirements for selecting vocational, technical trainers and supervisors are determined in accordance with instructions issued by the Council for this purpose, provided that the following criteria are observed:

  1. Technical capabilities
  2. Educational capabilities
  3. Personal abilities
  4. Practical experiences
  5. Pass the prescribed tests

Article 5-(A): Vocational and technical training trainers are classified into the following:

  1. Trainer of trainers
  2. Technical trainer
  3. Vocational trainer
  4. Theoretical trainer
  5. Practical trainer
  6. Crafts trainer
  7. Production trainer
  8. E-trainer or facilitator
  9. Any classification that the Council decides to add

(B): The vocational and technical training sector supervisors are classified into the following:

  1. Theoretical supervisor
  2. Practical supervisor / operators
  3. Training Supervisor
  4. Non-class activities supervisor
  5. Any classification that the Council decides to add

Article 6-(A): Organizing the occupational ranks/levels of vocational and technical training trainers to the following categories:

  1. Expert trainer
  2. Key trainer
  3. Trainer 
  4. Associate /Co-trainer
  5. Any occupational ranks/levels the Council decides to add.

(B): Organizing the occupational ranks/levels of vocational and technical training supervisors to the following categories:

  1. Expert supervisor
  2. General supervisor
  3. Supervisor 
  4. Associate/ Co-supervisor
  5. Any occupational ranks/levels the Council decides to add.

(C): The conditions and requirements of trainers and supervisors’ occupational ranks/levels shall be determined according to instructions issued by the Council for this purpose

Article 7 -(A): The Commission shall study the requests of technical and vocational trainers and supervisors to give them the license to practice or to cancel it.

(B): The Commission shall set up the necessary committees for the tests stipulated in this bylaw and to delegate the CEO of the Commission to grant the practice license or cancel it.

Article 8: Full-time trainers and supervisors working in vocational and technical training institutions, Before the provisions of this Bylaw come into effect, their conditions shall be reconciled in accordance with its provisions within one year from the date of its enforcement.

Article 9: The Commission shall develop a database that includes the information of the accredited providers of vocational and technical training services for the qualification of trainers, supervisors, the information of trainers, accredited and qualified supervisors.   

Article 10: The Commission shall collect, on the practice license, the following fees:

  1. 15 JOD fees for issuing a practice license.
  2. 10 JOD fees for issuing a practice license card.
  3. 15 JOD fees for translating any of the documents issued under the provisions of this bylaw.
  4. 10 JOD fees for license renewal. 
  5. 20 JOD fees for replacement of a Lost or damaged license.
  6. 10 JOD fees for substituting the practice licenses before the provisions of this bylaw come into force. 
  7. 10 JOD for each required test in accordance with the provisions of this bylaw.

Article 11: The Council shall issue the necessary instructions to implement the provisions of this bylaw.
